3. In the case of medical training, the Organiser may require the possession and confirmation of specified professional qualifications.
4. The Participant is not entitled to perform medical activities for which they do not hold the qualifications or authorisations required by law.
5. The number of places on a Training Course may be limited.
§ 10. Individual Masterclasses
1. A Masterclass may take the form of 1:1 training or training organised at the Customer’s clinic in accordance with the specific offer.
2. The date of a Masterclass is agreed individually.
3. Where a Masterclass is delivered at the Customer’s clinic, the Customer is required to provide the technical and organisational conditions, devices, equipment and other elements indicated in the offer or arrangements.
4. If the training requires a specific type of device, possession of a functioning device may be a condition for carrying out the practical part.
5. In the case of a Masterclass concerning 1470 nm endolifting, delivery is conditional on possession of an appropriate 1470 nm diode laser and compatible equipment enabling the procedure to be performed.
6. Failure by the Customer to provide the required equipment or conditions may prevent all or part of the training from being delivered.
§ 11. Webinars
1. Access details for the Webinar are sent to the Participant’s e-mail address or provided in another manner specified in the offer.
2. Access is intended solely for the authorised Participant.
3. Sharing the link, password or other access details with third parties without the Organiser’s consent is prohibited.
4. The Organiser is not responsible for inability to participate resulting from technical problems on the Participant’s side, unless mandatory provisions of law provide otherwise.
§ 12. VOD and Digital Content
1. Digital Content is supplied in the manner and for the period specified in the relevant offer.
2. Access is personal unless the offer provides otherwise.
3. Sharing access with third parties, copying, reselling, distributing or making Digital Content publicly available without appropriate authorisation is prohibited.
4. For Digital Content supplied before expiry of the statutory withdrawal period, § 17 and the relevant declarations made by the Customer during purchase apply.
§ 13. Participant cancellation, illness and absence
1. This section governs voluntary cancellation of participation in an Event and does not limit the statutory right to withdraw from the Contract where such a right applies.
2. After expiry of the statutory withdrawal period, after the right of withdrawal has expired, or where that right does not apply, the Customer has no contractual right to unilaterally cancel participation in the Event and demand a refund, unless the offer for the specific Event provides otherwise.
3. Illness of the Participant, a fortuitous event affecting the Participant, a change in professional or private plans, inability to obtain leave, transport problems, cancellation or delay of a flight, train or other means of transport, lack of required travel documents or other circumstances concerning the Participant do not in themselves constitute grounds for demanding a refund, subject to mandatory provisions of law.
4. The Participant’s absence on the day of the Event, late arrival, early departure from the Event or failure to use part of the services does not give rise to a right to a full or partial refund.
5. When preparing an Event, the Organiser reserves a place for the Participant and may incur in advance costs related to venue hire, materials, lecturers, travel, accommodation, technical support and organisation of the Event.
6. The above rules also apply to cancellations notified immediately before the Event, provided that the Customer does not have a statutory right of withdrawal in the given situation.
§ 14. Change of Participant
1. If the nature of the Event allows, the Customer may request that the place be transferred to another person.
2. The request should be sent to education@drdianadembicka.pl at least 7 days before the Event, unless the Organiser agrees to a change requested later.
3. The change requires confirmation by the Organiser.
4. The Organiser may refuse a change, in particular in the case of a 1:1 Masterclass, personalised certification, prior preparation of individual materials or the need to verify professional qualifications.
§ 15. Right of withdrawal from the Contract
1. A Consumer who has concluded a distance Contract generally has the right to withdraw from it without giving any reason within 14 days, except in cases provided for by applicable law.
2. In the case of a contract for the provision of services, the withdrawal period is generally calculated from the date the Contract is concluded.
3. If the Event is scheduled to take place before the expiry of 14 days from conclusion of the Contract, the Customer may be asked to make an express request for performance of the service to begin before expiry of the withdrawal period.
4. If performance of the service began at the Consumer’s express request before expiry of the withdrawal period and the Consumer subsequently validly withdraws from the Contract before full performance of the service, the Consumer is required to pay for the services actually performed up to the time of withdrawal, in proportion to the extent of performance, provided the conditions laid down by law have been met.
5. After full performance of a paid service, the right to withdraw from the Contract does not apply if the service was fully performed with the Consumer’s prior express consent, where before performance began the Consumer was informed that after full performance they would lose the right of withdrawal and acknowledged this.
6. Commencement of performance of the service may include activities constituting an actual element of the purchased service, in accordance with the nature and scope of the specific offer. The mere provision of purely organisational information does not automatically constitute full performance of the service.
7. A withdrawal declaration, if the right still applies, may be sent to education@drdianadembicka.pl or to: Dembicka Clinic & Education Center dr n. med. DIANA DEMBICKA-MĄCZKA, ul. Krakowska 61/1, 33-100 Tarnów.
8. To meet the deadline, it is sufficient to send the declaration before the deadline expires.
9. The Consumer may use the form attached as Appendix No. 1, but this is not mandatory.
§ 16. Commencement of service performance before the expiry of 14 days
1. If performance of the service is to begin before 14 days have elapsed from conclusion of the Contract, in particular where the Event takes place during that period, the Seller may require the Consumer to make an express request for performance to begin before expiry of the withdrawal period.
2. Depending on the scope of the specific offer, commencement of service performance may include the actual commencement of services forming part of the purchased service, in particular commencement of a Training Course, Masterclass or Webinar, individual preparation of the participant or other services expressly included in the purchased service.
3. If training materials constitute paid Digital Content or a separate element of a digital service, the rules set out in § 17 may also apply.
4. If the Consumer withdraws from the Contract after performance of the service has begun at their express request but before it has been fully performed, the Seller is entitled to payment for the part of the service performed up to the time of withdrawal, calculated in accordance with applicable law.
5. After full performance of the service with the Consumer’s prior express consent and after the Consumer has been informed in advance that the right of withdrawal will be lost after full performance and has acknowledged that information, the Consumer loses the right to withdraw from the Contract.
6. If the Event has been fully delivered in accordance with the Contract and the conditions indicated above have been met, a subsequent declaration of withdrawal does not give rise to an obligation to refund the price.
§ 17. Digital Content, training materials and loss of the right of withdrawal
1. This section applies to paid Digital Content not supplied on a tangible medium, in particular VOD recordings, paid electronic training materials, e-books, presentations, files and other Digital Content.
2. If the Consumer wishes to obtain access to Digital Content before expiry of the 14-day withdrawal period, the Seller obtains the express prior consent required by law and confirmation that the Consumer acknowledges the consequences of commencement of performance.
3. The Consumer loses the right to withdraw from a Contract for paid Digital Content not supplied on a tangible medium if the Seller began performance with the Consumer’s express prior consent, the Consumer was informed before performance began of the loss of the right of withdrawal and acknowledged it, and the Seller provided the confirmation of conclusion of the Contract required by law.
4. In particular, after VOD or other Digital Content has properly begun to be supplied in the circumstances described in paragraph 3, the Consumer may not subsequently validly withdraw from the Contract solely because they have already accessed the Content or no longer intend to use it.
5. Mere acceptance of the Terms and Conditions does not replace the separate consent required by law to begin supplying Digital Content in circumstances resulting in loss of the right of withdrawal.
6. The Seller provides the Customer with the required confirmation on a durable medium, in particular by e-mail.
§ 18. Purchase made immediately before an Event
1. The Customer acknowledges that purchasing a place at an Event less than 14 days before it begins means that the date of performance of the service falls before expiry of the standard withdrawal period.
2. In such a case, where required by law for performance to begin, the Consumer makes an express request for performance of the service to begin before expiry of the withdrawal period and confirms acknowledgement of the legal consequences of that request.
3. A purchase made less than 14 days before an Event does not automatically constitute a waiver of the statutory right of withdrawal.
4. Cancellation due to illness or other circumstances concerning the Participant does not, however, create an additional independent right to a refund.
5. If the Consumer still has a statutory right of withdrawal, its exercise is governed by §§ 15–17 of the Terms and Conditions.
§ 19. Cancellation of an Event by the Organiser
1. The Organiser may cancel an Event for important reasons, in particular due to illness of the lecturer, a fortuitous event, inability to secure a venue, a serious technical failure, an insufficient number of Participants – where such a possibility was provided for in the Event terms – or force majeure.
2. The Organiser will inform Participants of the cancellation without undue delay.
3. If the Event is definitively cancelled by the Organiser and is not delivered on an alternative date accepted by the Customer, the Seller refunds the price due for the service not provided.
§ 20. Change of date, venue, programme or lecturer
1. The Organiser may make justified organisational changes that do not fundamentally alter the nature of the purchased service.
2. Permitted changes may include, in particular, changes to the room, order of programme items, times of individual parts, organisation of the practical component or materials.
3. A change of venue within the same locality that does not materially affect the ability to participate does not in itself constitute grounds for a refund.
4. A change of lecturer is possible in exceptional and justified cases if the replacement has appropriate qualifications, unless participation of the specific lecturer constituted an essential characteristic of the purchased service.
5. In the event of a material change of date or material change to the conditions of the service, the Customer’s rights under applicable law remain unaffected.
§ 21. Force majeure
1. Force majeure means an extraordinary external event beyond the reasonable control of a Party, the effects of which could not reasonably have been foreseen or avoided.
2. Such events may include, in particular, acts of war, border closures, natural disasters, decisions of public authorities, serious transport disruptions, infrastructure failures, epidemics or other events of a comparable nature.
3. In the event of force majeure, the Organiser may, depending on the circumstances, propose a change to the date, form or manner of delivery of the Event.
4. This section does not exclude the Customer’s rights arising from mandatory provisions of law.
§ 22. Complaints
1. The Customer has the right to submit a complaint concerning performance of the Contract.
2. A complaint may be sent to education@drdianadembicka.pl.
3. To facilitate processing, it is recommended to provide the first and last name, Order number, name of the service, description of the problem and the Customer’s request.
4. Failure to provide the above information does not automatically result in rejection of the complaint if its subject matter can be established.
5. Complaints will be considered within the time limits resulting from applicable law.
§ 23. Copyright and prohibition on recording
1. Training materials, presentations, photographs, films, recordings, diagrams, graphics, protocols and other materials made available to Participants may constitute works protected by copyright.
2. Purchase of a Training Course or Digital Content does not transfer economic copyright.
3. The materials are intended solely for use by the authorised Participant within the scope arising from the Contract.
4. Without appropriate consent, it is prohibited in particular to copy, distribute, publish, resell, make available to third parties or use the materials to conduct one’s own paid training in a manner infringing copyright.
5. Audio or video recording of a Training Course, Masterclass, Webinar, lecture or practical component requires the prior consent of the Organiser and the lecturer.
6. Sharing access details for VOD or a Webinar with third parties is prohibited.
§ 24. Educational nature and professional responsibility
1. Training Courses are educational in nature and are intended to improve professional knowledge and skills.
2. The Participant is responsible for applying the acquired knowledge in accordance with their qualifications, applicable law, current medical knowledge, instructions for the devices used, indications, contraindications and safety rules.
3. Completion of a Training Course does not in itself confer professional authorisations where obtaining them requires additional conditions laid down by law to be met.
4. The Organiser does not guarantee achievement of specific professional, clinical or financial results as a result of participation in a Training Course.
§ 25. Certificates
1. If the offer provides for issuance of a certificate, receipt of the certificate may be conditional on participation in the required scope of the Event, completion of specified exercises, fulfilment of organisational requirements or other conditions indicated before the Training Course begins.
2. The certificate confirms participation in or completion of the specified training to the extent described by the Organiser.
3. The certificate does not replace professional authorisations required by applicable law.
§ 26. Entrepreneurs and Entrepreneurs with consumer rights
1. The statutory consumer right of withdrawal does not apply to an Entrepreneur who is not granted consumer protection in this respect by applicable law.
2. A purchase made by an entrepreneur does not, however, automatically exclude provisions protecting a natural person conducting business activity where the specific Contract is not of a professional nature for that person and the law grants that person consumer protection.
3. The provisions of the Terms and Conditions do not limit the rights of an Entrepreneur with consumer rights to the extent arising from applicable law.
§ 27. Personal data
1. The Seller is the controller of personal data.
2. Detailed information on the processing of personal data is set out in the Dembicka Education Center Privacy and Cookies Policy.
3. The Privacy Policy also contains information on the tools and external entities used, in particular Stripe and – depending on the current configuration of the website – analytics and marketing tools.
§ 28. Out-of-court dispute resolution
1. The Consumer may use out-of-court methods of handling complaints and pursuing claims provided for by law.
2. Information on available options may be obtained, among other sources, from the competent consumer ombudsmen and from information published by the President of the Office of Competition and Consumer Protection.
§ 29. Amendments to the Terms and Conditions
1. The Seller may amend the Terms and Conditions for important reasons, in particular due to changes in law, the scope of services provided, payment methods, Store functionality or the manner in which services are performed.
2. An amendment to the Terms and Conditions does not affect the terms of Contracts concluded before it enters into force, unless mandatory provisions of law require the new rules to be applied.
§ 30. Final provisions
1. Contracts are governed by Polish law, subject to provisions protecting Consumers whose application cannot be contractually excluded.
2. Matters not regulated by these Terms and Conditions are governed by the relevant provisions of Polish law.
3. The invalidity or ineffectiveness of an individual provision of the Terms and Conditions does not result in the invalidity of the remaining provisions, insofar as applicable law permits their continued application.
4. These Terms and Conditions are effective from 14 September 2026.

APPENDIX NO. 2
IMPLEMENTATION INFORMATION FOR THE IT SPECIALIST – CHECKOUT
The following elements should be reflected in the purchasing process. The purpose is to synchronise the checkout with the provisions of the Terms and Conditions, in particular with regard to commencement of performance before the expiry of 14 days and Digital Content.
IMPORTANT – TECHNICAL Checkboxes concerning statutory consents should not be pre-selected by default. The system should record the wording of the consent, the date and time it was given, the Order identifier and – to the extent consistent with the Privacy Policy – data enabling proof that the declaration was made by the Customer. Confirmation should be sent to the Customer on a durable medium, in particular by e-mail. |
1. Acceptance of the Terms and Conditions
Checkbox required for every purchase, not pre-selected by default:
“I have read the Dembicka Education Center Online Store Terms and Conditions and the Privacy Policy and I accept the Terms and Conditions.” |
2. Purchase of a service that is to begin before the expiry of 14 days
If the date of a Training Course, Masterclass or Webinar falls within 14 days of purchase, or the service is to begin to be performed earlier, an additional checkbox should be displayed, not pre-selected by default:
“I request that performance of the purchased service begin before expiry of the 14-day period for withdrawal from the contract. I acknowledge that if I withdraw after performance of the service has begun, I will be required to pay for the services performed up to the time of withdrawal, in proportion to the extent of their performance, and after full performance of the service – once the conditions laid down by law have been met – I will lose the right to withdraw from the contract.” |
3. VOD and paid Digital Content made available immediately
For VOD, e-books, files and other paid Digital Content supplied immediately before expiry of 14 days, a separate checkbox should be used, not pre-selected by default:
“I expressly consent to the supply of the purchased Digital Content beginning before expiry of the 14-day period for withdrawal from the contract. I have been informed and acknowledge that once supply of the Digital Content has begun, provided the conditions laid down by law have been met, I will lose the right to withdraw from the contract.” |
4. Button finalising the purchase
The button finalising a paid Order should clearly indicate the obligation to pay. Recommended wording: “Order and pay”, “Pay now” or other equally unambiguous wording. A neutral button that does not indicate the obligation to pay should not be used.
5. Purchase confirmation e-mail
The automatic e-mail should contain at least: the name of the purchased service or Digital Content, price, Order date, Seller details, a link or attachment to the current Terms and Conditions and – where applicable – confirmation of the Customer’s requests and consents concerning commencement of performance before expiry of 14 days or commencement of supply of Digital Content.
6. Checkout logic by product type
Product type | Terms and Conditions | Consent < 14 days | Digital Content consent |
Training Course >14 days | YES | NO | NO |
Training Course <14 days | YES | YES | NO* |
Live Webinar >14 days | YES | NO | NO |
Live Webinar <14 days | YES | YES | NO* |
VOD / e-book / file immediately | YES | NO** | YES |
Masterclass <14 days | YES | YES | NO* |
* If separate paid Digital Content is supplied as part of a given product before the event, it should additionally be assessed whether consent concerning Digital Content is also required.
** If VOD or Digital Content is at the same time an element of a broader service, the checkout logic should be determined in accordance with the structure of the specific offer.
7. Elements the system should record
• Order identifier and Customer/Participant identifier;
• date and time the Order was placed;
• version of the Terms and Conditions accepted by the Customer;
• information on which checkboxes were selected;
• exact wording of the declarations applicable at the time of purchase;
• date and time consents were given;
• information on sending the confirmation e-mail and its content or template;
• date on which performance began or Digital Content was made available, if recorded by the system.
8. Important – no automatic “waiver” of the right
A checkbox such as “I waive my right to withdraw from the contract” should not be used for an ordinary Training Course. The mechanism should correspond to the type of performance: for services – a request to begin performance before expiry of 14 days and information about the consequences; for paid Digital Content – separate consent to begin supply together with acknowledgement of loss of the right in the cases provided for by law.
